Terms of Service

Please read these Terms of Service ("Terms") carefully before using www.janksbinder.com (the "Site") or placing an order. By browsing the Site or placing an order, you agree to these Terms.

1. About us

The Janks Binder is operated by Davin Chee, an individual based in Singapore, as an unregistered sole individual (not a company or ACRA-registered business). You can reach us at hello@janksbinder.com or via @janksbinder on Instagram/Telegram.

2. What we sell

We sell individual Pokémon Trading Card Game ("TCG") cards ("Products"). Unless a card is explicitly listed as professionally graded (e.g. PSA, BGS, CGC), all cards are ungraded and their condition (e.g. Near Mint, Lightly Played) reflects our own good-faith visual assessment, not a third-party grading standard. Card images shown on the Site are representative stock images of that specific set and card number, not necessarily a photo of the exact physical card you will receive, unless stated otherwise.

3. Orders and stock

• Placing an order creates a "Pending" order. It is not confirmed until we (or, for card payments, our payment processor) confirm it.
• Because stock is limited to what's physically in hand, it is possible in rare cases for a card to sell out between the time you order and the time we confirm your order (for example, if two orders for the same card are placed close together). If this happens to your order, we will contact you as soon as possible to offer a substitute, a partial refund for the affected card, or a full refund of your order.
• We reserve the right to cancel any order at our discretion, including for suspected error, fraud, or unavailability of stock, in which case any payment already made will be refunded.
• Prices are listed in Singapore Dollars (SGD) and may change at any time without notice. The price charged is the price shown at checkout at the time your order is placed.
• We are not currently GST-registered, so GST is not charged on orders.

4. Payment

We accept:

• PayNow — a manual bank transfer. Your order is confirmed once we've verified receipt of payment in our bank account.
• Card payments via Stripe — processed automatically. A card processing fee of SGD $0.50 applies to card payments. We do not see or store your full card details; these are handled directly by Stripe. See our Privacy Policy for more.

Delivery fees (see below) and any applicable card fee are calculated and shown at checkout and are non-negotiable regardless of what a customer's browser or device displays.

5. Delivery and self-collection

• Self-collection: arranged at a mutually agreed time and location within Singapore, provided at no additional charge.
• Shipping: a flat SGD $3.00 fee applies. We aim to ship the next business day after order confirmation; delivery typically arrives within 4 business days, though this is an estimate, not a guarantee, and depends on Singapore's postal/courier service.
• Risk in the cards passes to you once they are handed to you (self-collection) or handed to the courier (shipping). If your parcel arrives visibly damaged or the cards inside are damaged, see our Refund Policy.

6. Returns and refunds

Please see our separate Refund Policy, which forms part of these Terms.

7. Accuracy of listings

We do our best to keep card names, numbers, rarities, variants, and stock counts accurate and up to date, as inventory is updated daily. Occasionally errors happen (a typo, an outdated price, a card already sold but not yet removed). If we discover an error in your order after you've paid, we'll contact you before proceeding and you may choose a substitute, partial refund, or full refund.

8. Age and eligibility

Our Products are collectible cards, not intended for children under 3 due to small parts. If you are under 18, you confirm you have a parent or guardian's permission to make a purchase and to share the personal data needed to fulfil your order.

9. Acceptable use

You agree not to use the Site to attempt to defraud us or other customers, interfere with the Site's operation, or scrape/republish our inventory data for commercial purposes without our permission.

10. Limitation of liability

To the fullest extent permitted by law, The Janks Binder's total liability to you for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses (for example, loss of a set-completion opportunity, or a change in a card's market value).

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Singapore law, including under the Consumer Protection (Fair Trading) Act 2003.

11. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time you place an order is the one that applies to that order. Continued use of the Site after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Singapore, and any disputes will be subject to the exclusive jurisdiction of the courts of Singapore.
